The Heinous, Incredulous MENDIOLA MASSACRE, January 22, 1987

STUNNED. That's the best word to describe my mind's reaction to the Mendiola Massacre.  Exactly 24 years ago today, Thursday morning when I learned of the massacre incident that occurred at historic Mendiola the previous day.

I remember walking into the college library and seeing from a distance the headline in a newspaper my classmate was reading, held up with both hands to eye level. The picture of the lifeless bodies on the streets. The headline says Mendiola. Oh, well, he's reading an archive newspaper from Ferdinand Marcos' dictatorship days, I thought.



Taking my seat beside him, I learned a most incredulous truth. That was no old Martial Law newspaper. The headline--it was that day's major news! Shocking, shocking news! After driving away the "evil" dictator, that Marcos, that heartless 'human-rights violator,' and installing the good gal, widow of beloved hero Ninoy Aquino via the most peaceful EDSA  revolution, we get this????

How can farmer rallyists be possibly  murdered just like that under the "democratic" presidency of Tita Cory? Marcos, the 'bad guy,' is gone, right? It actually took several seconds (or was it minutes?) before that reality sank in. It was simply unbelievable.


NOT Cory. ???

At any rate, Ninoy was my hero and his widow, the restorer of Philippine democracy. My mind had to reconcile the fact of the heinous Mendiola massacre with my view of the Corazon Cojuangco Aquino presidency. It must be the fascist military elements, I thought. No way Cory could have ordered that. That coup-plotting Juan Ponce Enrile and his RAM boys must have been behind that gruesome daylight massacre.

Of course, now I know better. Cory could not have been that innocent because, otherwise, her administration should have allowed the State to be sued.  The case that began from the suit filed by the heirs of the 13 deceased victims and the injured who sued for damages against the Philippine Republic was eventually dismissed, affirmed by the Supreme Court because the State refused to given its consent to be sued. Besides, Cory was not exactly friends to noisy farmers who demand the just call of land reform. Cory's land reform program--the Comprehensive Agrarian Reform Program (CARP)--was baloney since she  couldn't even set the 'supreme sacrifice'  of her family's Hacienda Luisita to genuine land distribution.


Fake, (Hacienda Luisita) Designer Land Reform

While the 1987 Mendiola Massacre involving the death of farmers pressing for genuine agrarian reform seemed to have made Cory speed up the implementation of land reform but not without first inserting a novel Stock Distribution Option (SDO) into her Comprehensive Agrarian Reform Program or CARP (now the Comprehensive Agrarian Reform Law or CARL). The SDO gives farmer tenants shares in a plantation corporation without actually transferring land. SDO had been criticized not only as possibly unconstitutional but more so, as a way for landowners to keep control of the land and farmers–and for the Cojuangco-Aquinos to avoid distributing Hacienda Luisita. As well, the Cory administration had the Court of Appeals dismiss the government case filed against the TADECO owners, who were no less than the President’s own family and kin (she is said to have divested herself of personal shares in the company).

When CARP took effect in 1989, the Cojuangco family adopted the SDO option despite many criticisms that the option disadvantaged the farmers. Only less than 5,000 out of the nearly 6,500 hectares of the original Hacienda Luisita land were submitted to the Agrarian Reform department. The exclusion of the combined 386.6 hectares of residential, commercial, road and other land improvement portions of the hacienda markedly lowered the value of land earmarked for land reform to only P40,000 per hectare. The valuation process was also seen as irregular if not appropriate, with the standing crop not only being included but also being categorized as non-land asset. The result is that when the land was incorporated into what is now Hacienda Luisita, Inc. (HLI) as spin-off of TADECO, the farmers became nominal shareholders, getting only 33.296% versus the 66.704 percent shares of the Cojuangco-Aquinos.


Gruesome Open Massacre

I found this actual video of the bloody, "historic" massacre 24 years and one day ago, LESS THAN A YEAR into the Cory Aquino presidency. The video is rather so gruesome that watching it yesterday initially made me don the same incredulous reaction I had back in my college days when I first learned the news of Mendiola Massacre.

The military back then--up to now--even had the guts to blame the farmer groups for supposedly having been infiltrated by the communist New People's Army (NPA).  That was usual red scare stuff, of course. It is perhaps fortunate that some survivors of the "Black Thursday" massacre are still alive to tell their grim tales. Teresita Arjona, who was with her mother during the rally, tells of "owner-type" jeeps  running around as the protesters were being shot at. Communist handiwork? I don't think so.

“Suddenly I heard shots. I didn’t know at first that they were gunshots; it sounded more like clapping. First it was intermittent, then soon the sound was loud and deafening. There was chaos, everyone began running away from the sound of gunfire. Men, women, children were running. Yes, there were children with us that day. I also ran, and I am a little ashamed even now to admit that I failed to help those whom I saw fall on the pavement. It was all I could do to keep from falling myself.”

Teresita Arjona:
“Everyone was running, running every which way. All I could think of was getting to Lawton where the caravan vehicles were; that and returning to my children. I didn’t know what happened to Danilo, I didn’t see if he was able to run or get away. I was crying as I ran and I didn’t immediately notice that my mother and I were both barefoot. The streets were littered with slippers and bags and streamers and placards. People were yelling, but I didn’t know if it was in pain or in outrage,” she says.

Nanay Tess herself felt rage when she saw, even as she ran for safety, that there were “owner-type” jeeps driving alongside the protestors who were scurrying for safety. “They were shooting at us, at everyone who was running!” she says, anger in her eyes, in her voice.

Mendiola Massacre according to Bulatlat (excerpts):
On Jan. 22, 1987, some 10,000 to 15,000 farmers marched from the agrarian reform office in Quezon City to Mendiola in Manila to remind the late former president Corazon C. Aquino to make good on her word to implement genuine agrarian reform. According to reports, anti-riot personnel under the command of then Capital Regional Command commander Gen. Ramon MontaƱo, Task Force Nazareno under the command of Col. Cesar Nazareno and police forces under the command of Western Police District (WPD) Chief Brig. Gen. Alfredo Lim had been prepared to block the protestors.

The phalanx of civil disturbance control units was comprised of policemen from the WPD, members of the Integrated National Police Field Force, members of the Philippine Marine Corps, and the Marine Civil Disturbance Control Battalion. Behind the line of these fully armed personnel were army trucks, water cannons, fire trucks and two Mobile Dispersal Teams prepared to launch tear gas.
At the back of the marines were four 6×6 army trucks, occupying the entire width of Mendiola street, followed immediately by two water cannons, one on each side of the street and eight fire trucks, four trucks on each side of the street. Stationed farther behind the CDC forces were the two Mobile Dispersal Teams (MDT) each composed of two tear gas grenadiers, two spotters, an assistant grenadier, a driver and the team leader.

As the farmers reached Claro M. Recto, the government forces attacked. In the melee, 13 farmers were killed, 39 were wounded by gunshots, and 20 suffered various injuries. Killed were Danilo Arjona, Evangelio, Leopoldo Alonzo, Angelito Guiterrez, Adelfa Aribe, Rodrigo Grampan, Dionisio Bautista, Bernabe Laquindanum, Roberto Caylo, Sonny Boy Perez, Vincent Campomanes, Roberto Yumul, and Ronilo Dumanico.

In the immediate aftermath of the massacre, the peace panel of the National Democratic Front of the Philippines (NDFP) withdrew from peace talks with the Government of the Republic of the Philippines (GRP).

Fallen Young Red Fighter Kemberly Jul Luna - Within the context of the EDSA 2-Arroyo/Ramos-CPP-NPA connection

THE death of 21-year-old Kemberly Jul Luna caused quite an uproar in the activist and leftist circles. Jul was a popular, charming, merry, and yes, beauteous, true-blue scholar ng bayan with multiple talents and interests from the Mindanao State University (MSU). She died a comrade, a member of the New People's Army (NPA), the military arm of the Communist Party of the Philippines (CPP), during a days-long battle with the military in Sitio Bulacao in Valencia, Bukidnon last December. Her tragic, principled (or ideological?) death made me ponder on the current state of the communist movement in the Philippines.


"Kimay"

Called "Kimay" by friends, she was a high school valedictorian from Tubod, Surigao del Norte who enrolled in AB English at MSU. True to the calling of her age, she initially lived what the Philippine Daily Inquirer described as "bon vivant lifestyle" marked by late-night parties. Despite, she still managed sustained academic performance and a host of campus cultural activities. Intelligent, active, party-goer, yet socially involved, Kimay was once a leader of the Catholic Center Campus Ministry and member of the Kalimulan cultural dance troupe until she embraced the leftist perspective.

In February 2008, she became an active member of the League of the Filipino Students. Supposedly, that was the time Kimay "shed herself off of all the petty-bourgeois individualism." By the first semester of school year 2008-2009, she was chosen as adhoc chairperson of MSU's opposition party, STAND-IIT.


Came second semester and she did not enroll as she completely turned to a very radical path. According to STAND-IIT spokesperson Mark Jason Tan Cesar, "She wanted to serve the poor and she was very resolute. She told us that she wanted to work with the peasants in the countryside. There was no stopping her.”

October of the same year, she bravely took part in uncovering the impact of militarization and indiscriminate aerial bombing of war-torn Tagoranoa village in Poona Piagapo in Lanao. She then engaged in full-time work organizing peasants as she reportedly joined the province-wide KASAMA-Bukidnon organization January of 2009.


Young, Scholar of the Masses, NPA, Dead

In August 2009, she informed friends that she left KASAMA-Bukidnon, saying only that has developed greater love for the peasants with every passing day she lives among them. She became an NPA.

Kemberley was reported missing in mid-December 2009 by human rights group KARAPATAN-Bukidnon Chapter. When her body was found days later, it was already much decomposed and dumped with those of seven other alleged NPAs in the forest of Brgy. Concepcion.


CPP-NPA & 'National Liberation'

Columnist Herman Tiu-Laurel laments and questions Kemberley's death, saying that "She follows a long line of fallen young warriors over the past five decades which include several of my own friends and comrades. Is this still the right way to fight for national liberation?"



For its part, the Communist Party of the Philippines released a press release saying:
Her martyrdom is extolled as well by the peasant masses whom she intimately lived with and served as a Red fighter and medic of the NPA until her last day... Her life of tireless work and selfless sacrifice for the downtrodden will forever be etched in the hearts of those she loved, worked and died for.

Unholy Mix: CPP and EDSA 2

I'm not exactly endorsing the path July chose to take. I do respect her decision because the depth of her patriotism led her to offer and sacrifice her youthful, promising, beautiful life in pursuit of her conception of 'national liberation.'

However, the organization she embraced, the CPP-NPA, the Communist Party of the Philippines of the present time, to my mind, showed itself too flexible principle-wise when it took part in EDSA II--what a foreign media outfit described as "the opportunist coalition of church, business elite and left....". I expected better from Jose Maria Sison's group, as I remember questioning back then why they would even consider joining forces with those of Gloria Macapagal Arroyo and former President Fidel Ramos whom then-President Joseph Estrada wanted charged for the Centennial Expo and other corruption scandals.

While I don't subscribe to any form of totalitarianism, whether left or right, or religious, I've harbored respect not only for the personal conviction and sacrifice of its members but, as well, for the underground organization's principles. Back in 1985-86, the Philippine communist movement was chided for its decision not to support or join the EDSA I (original) "People Power" Revolution. The 'culprit' was its strict adherence to its principles such that the movement was unwilling to compromise enough to accommodate the unified opposition led by Corazon "Cojuangco" Aquino and Salvador "Doy" Laurel.

Arguably, the CPP-NPA should not have merely stayed at the sidelines during the historic 1986 Edsa 1. Definitely, to my mind, the Philippine Reds should NOT have shifted to opportunist mode during Edsa 2 which aimed for nothing but oust the not-entirely-clean but, nonetheless, relatively patriotic and nationalist Estrada.

By taking part in the ouster of the pro-masa and genuinely elected Erap by coalescing with unquestionably fascist and elite elements, the local communists have indicated their dangerous adoption of what can be seen as counter-revolutionary strategy and anti-populist mind frame at will.


Gloria Arroyo, Part of Joma’s Foresight?

Then again, is it possible that the CPP-NPA calculated that a Gloria Arroyo presidency would be more conducive to their goals? Way back before Gloria was able to grab the presidency, she was without question already a fascist, even imperialist agent.

Along with then President Ramos, Senator Arroyo was responsible for Philippines' membership in the General Agreement on Tariffs and Trade-World Trade Organization (GATT-WTO) in 1995. She was also the principal author of what has been called "the most environmentally-hazardous law of the land," Republic Act 7942 or the 1995 Mining Act, which permits foreigners a hundred percent ownership of the country's mines.


Compare Gloria to Estrada, who, despite the latter's agreement to the Visiting Forces Agreement (VFA), nonetheless braved neo-imperialist foreign interests by removing sovereign guarantees on government contracts. Did CPP-NPA leader Joma Sison figure that replacing the rather 'uncouth' but popular and pro-masa Estrada with 'fascist' Gloria Arroyo could speed up their brand of national liberation struggle?


2008 Mindanao War: Gloria, Kimay & Joma

It's been speculated that Arroyo virtually cooked up the October 2008 war in Mindanao to present an excuse to declare Martial Law in the country and extend her term scheduled to end in June 2010. Her administration signed the Memorandum of Agreement-Ancestral Domain (MOA-AD) with Muslim rebels while well aware that such dismemberment of the Republic won't be allowed by the Christian community not only in Mindanao but in the capital. According to an October 2008 Malaya editorial, the MOA-AD is an "elaborate charade... [apparently designed] to provoke the MILF into going back to war as what is happening now" after the Supreme Court TROed the agreement.

A few months after seeing first-hand the horrors wrought on Davaoenos by the Mindanao war , Kemberly advanced from full-time peasant organizing to become an NPA. Wonder if Joma Sison foresaw Gloria's Illegitimacy would turn the 2001 power grabber into a devil-may-care megalomaniac, thus inadvertently serving as a hopefully effective NPA recruiting machine?

The last paragraph in the January 8, 2010 CPP press release on Kemberley Jul Luna's death reads:
Let us pay tribute to Kimay by amplifying the call for student, youth and other activists to join the New People's Army. As the people's revolution gears for greater advances, there is a growing need for more youth and students and activists from the other sectors to sign up as Red fighters, combine with the peasants and workers and contribute to carrying out the tasks of people's war with unprecedented vitality.

EDSA II - Part of Joma's Foresight, or Plain Mob Crazy?

It is a fact that the Arroyo administration is credited with the most number of salvagings, desaparecidos, and human rights violations in Philippine history, largely targeting the activists and socialists. Has the Philippine Left been had by Arroyo and Ramos when its members supported the EDSA 2 ouster of Estrada?

Or did Joma, et al. chose to avoid a more progressive administration to advance its “people’s war”? I’ve long harbored the suspicion that why Joma’s group went against Erap and took the side of the clearly fascist (or more fascist) Arroyo and Ramos was because Estrada’s ‘bakya‘ or masa appeal presented a strong competition in winning the masses, whose support they need in order to further their war style towards national liberation.

Of course, I could be wrong. I hope I’m dead wrong.

Then there’s the possibility that neither applies for the 2001 Edsa coup. If I remember accurately, broadcaster Korina Sanchez-Roxas commented back in early 2001 as to what could have possibly brought about Edsa 2, saying something like “It’s as if a cloud of something descended upon the people who took part in it.” It is not entirely impossible that the Edsa II people simply went mob crazy. So crazy they went the side of Centennial-Expo-defensive Eddie, ‘Tabako’ Eddie....

POWER GRAB FROM PRESIDENT JOSEPH ESTRADA

The victim: the democratically elected President Joseph "Erap" Estrada.

The conspirators
: Bogus President Gloria Macapagal Arroyo and husband; Mike Arroyo; ex-President Fidel Ramos; Jaime Cardinal Sin; business elites; Armed Forces chief Angelo Reyes, Supreme Court chief justice Hilario Davide, etc.

The unwitting conspirators: the gullible mob of Edsa 2.

The greater victims: Philippine democracy and the millions who cast their votes in the 1998 Presidential elections.

According to the Honorable Cecilia Munoz-Palma, former Supreme Court Justice and chairperson of the 1987 Constitutional Commission, Edsa 2 caused the 1987 Constitution to suffer.
This happened when the ongoing impeachment trial of President Joseph Estrada, was unceremoniously disrupted and discontinued, and the issues on hand were brought to the streets. The rule of law was set aside and the rule of force prevailed..

Obama's 'strategic interests' call to SE Asia's notoriously corrupt leader

It's all over the news. Proudly propagated by the PR, nay, propaganda, machinery of Philippine President Gloria Macapagal Arroyo. United States President Barack H. Obama called Arroyo last March 14, 2009 to discuss the critical importance of the two countries' "bilateral relationship and... strategic interests," specifically the Visiting Forces Agreement that spells a mutual defense understanding. The call has long been sought after by Malacanang. Finally, after dodging her huge efforts to speak or meet with and use him for political photo-op her not once, not twice, but thrice, Obama decided to end the hide-and-seek game he played with Arroyo, the leader perceived to be the "Most Corrupt Philippine President" in history.

Obama is the 44th US President who campaigned on a mantra of "Hope, Change." He had successfully bested Hillary Clinton, the first viable female president in American history for the Democratic presidential nomination. He then went on to soundly defeat his Republican opponent for the presidency, John McCain, in the November 2008 polls.

In his inauguration speech, Obama indicated a foreign policy seemingly inimical to those leaders "who cling to power through corruption and deceit and the silencing of dissent ...on the wrong side of history." His counterpart, Gloria Macapagal Arroyo, was sworn in as the 14th Philippine President at about the same time as his predecessor George W. Bush. Arroyo took office following the paraconstitutional change of power afforded by the EDSA II "People Power" of 2001, which was described by international media and analysts as the "opportunist coalition of church, business elite and left,"' and as "mob rule or mob rule as a cover for a well-planned coup."

From practically Day 1 of Arroyo's administration, she has been besieged by an almost endless litany of illegitimacy and corruption issues. Scandals after scandals have hounded her. To name just some: the IMPSA power plant deal; "Hello Garci?" wiretapping expose of cheating in the 2004 presidential polls; bribery of congressmen and governors at Malacanang; the Bolante fertilizer scam; the kangaroo court "guilty" verdict on the Estrada plunder case; and the abrogated NBN-ZTE deal. The latest, divulged only in January this year, is the collusion between roads project contractor and First Gentleman Mike Arroyo, alleged in a report made by no less than the World Bank.

No wonder that in October 2007, surveyed Filipinos expressed their perception that Arroyo is the "Most Corrupt President in Philippine History." Malacanang's current occupant has faced a number of unsuccessful challenges, including four successive impeachment complaints, two or three military mutinies, and a rectifying "People Power" exercise, EDSA 3, which sought to restore the presidency of the deposed but democratically elected Joseph Estrada early on in her term. Only in February, 2009, ten military groups of retired and active servicemen paid an advertisement declaring their support behind a brigadier general on court martial trial for the February 2006 uprising.

Jetset Stalking of Obama

Arroyo had gone on an aggressive seeking of the opportunity to meet up and try forging close relations (translation 2: stalking) with Obama as early as June 2008 when he was yet the presumed Democratic presidential nominee--apparently to ensure the political support of Bush's successor to her precarious presidency.

Her first attempt came via an expensive, 10-day, non-state visit to the US in the midst of the American presidential electoral process, but which failed to obtain even a glimpse of his charismatic presence. The next stalking came in November when she went again to the US on the pretext of attending a UN-sponsored "interfaith dialogue," even as she futilely chased Obama all the way to his Chicago hometown. The third time, in January this year, she suddenly diverted to Washington, DC, instead of flying home after attending the Davos World Economic Forum, just to be in the National Prayer Breakfast graced by Obama. Despite spending millions of the Filipinos' money, despite literally going out of her way, and despite breaking basic rules of protocol and even self-respect, Arroyo was humiliated the third time big time, as she failed to get any face time with Obama. Not even a word acknowledging her presence before the forum crowd of some 4,000 guests.

The costs of Arroyo's desperation-level jetsetting to stalk Obama have been very high for the Philippines. The June 2008 junket, the largest in the country's history, was enjoyed by no less than 60 solons and 10 cabinet officials. It went on despite the battering that Typhoon Fengshen inflicted on a considerable part of the Philippines. The third time proved too much, as not a few took notice and assailed her for 'wasting public funds chasing Obama.'

This author has been pleasantly amused by Obama's initial refusal to be used by Arroyo or be associated with her corrupt government early on, but is history smart enough to know that that it was only a matter of time before he starts dealing with her. For some three months, he managed to keep the controversial Philippine President at bay, and project a clean-as-promised image to the world. Less anyone forget, however, Obama is duty bound to uphold "US interests" first and foremost.

After all, in a period following the expulsion of the US bases by the Philippine Senate in 1991, America has needed to exert greater efforts to steer Manila's policies in line with Washington's strategic and economic interests in its former colony. From the time America colonized the Philippines at the turn of the 20th century until about the time of Ferdinand Marcos, Manila was a virtual pawn of superpower Washington.

It supposedly began on a spiritual plane, on the night of October 24, 1898 when US President William McKinley arrived at the decision to colonize the Philippine Islands after the "voice of God" told him "to take them all, to educate the Filipinos, and uplift and Christianize them."

Rightists embrace the US as an ally, while the leftists brand America a neo-imperialist that has continued to exploit its former colony even during the post-World War Independence period. Particularly during the time when the US still had its military bases, and the Central Intelligence Agency had its SE Asian main station/regional headquarters in Manila, Philippine presidents were de facto obliged to toe the American line--or risks severe consequences. During a Cold War period when clandestine CIA operations were marked by intervention, deception, psychological warfare, instigations of military coup d'Ʃtat and even the assassinations of foreign political leaders such as Chile's Salvador Allende (contained in the 1975 Church Committee Report of the US congressional investigations), the price of displeasing Uncle Sam was tough. Nationalist Filipino Senator Claro M. Recto, who ran for president during the November 12, 1957 Philippine elections, paid the price with having to endure a bag of dirty tricks propaganda, and later, with his life. For having actively opposed the military presence of the US in his country, his presidential campaign was immorally and deviously sabotaged by the CIA.

This agency-apparatus of US imperialism ran foul operations that included the distribution of holed condoms sealed in packages labeled with "Courtesy of Claro M. Recto--the People's Friend." During a more conservative era, just the condom themselves would have repulsed Filipinos, and having them holes would have been seen as most obscene. The CIA work on Recto apparently did not end there. On October 2, 1960, Recto 'mysteriously' died of heart attack in Rome, Italy while on a cultural mission on the way to Spain. Before he died, Recto was visited by "two Caucasians" donned in business suits. The possible involvement of the CIA in his death came to light following the subsequent release of US government documents revealing that CIA Chief of Station Ralph Lovett and US Ambassador to the Philippines Admiral Raymond Spruance had discussed the murder of Recto with a vial of poison.

On the "bright" side, Filipino leaders who kowtowed to the former colonial master and espoused the American line were well rewarded. The successful presidential campaign of Ramon Magsaysay in November 1953 was largely helped by CIA operatives David Sternberg who posed as a foreign correspondent for the Boston-based Christian Science Monitor, and New York lawyer and Republican Gabriel Kaplan. Under Magsaysay's term, a high-level US committee report found out how "American policy in Southeast Asia was most effectively represented in the Philippines, where any expanded program of Western influence may best be launched."

The Call over High Seas

Day 0 - Saturday (HK GMT) March 14, 2009 Obama calls Arroyo

Day 1 - Sunday (HK GMT), March 15, 2009 Malacanang proudly propagates news of the call

But deal with her Obama has begun. The call to Arroyo last March 14 was described by the drumbeaters of an ecstatic Malacanang as a "surprise" communication. After playing elusive for months, what issue of US interest could have possibly prompted Obama to finally make contact with the notoriously corrupt SE Asian leader?

The answer is found in the high waters of the Asia and Pacific region. The Philippines is a strategic pawn in the high stakes power game the US plays amidst its decreasing might in Asia-Pacific. The main challenge comes from China, now the world's largest economy and an emerging global power. Two weeks before, Washington and Beijing had a spat over the interception by five Chinese vessels of the unarmed USNS Impeccable that was conducting surveillance operations in a disputed part of the South China Sea. The Philippines itself is in a territorial dispute with China over the inclusion of some islands in the Spratlys in the former's Archipelagic Baselines Law.

Philippine Sovereignty & Convicted Rapist US Marine Daniel Smith

According to Arroyo's Press Secretary, Obama called to reaffirm the alliance of US with the Philippines and the commitment to the VFA "which remains critical to the bilateral relationship and our strategic interests".

The scrape with China, which came two weeks before the call to Arroyo, presumably impressed on the new US President the urgency to ensure that the US mutual defense agreement with the Philippines be maintained-at practically all costs.

The VFA, which became effective in 1999, has actually been a controversial agreement among Filipinos since the beginning because of provisions that apply US jurisdiction over its military personnel accused of, or found to, have engaged in crimes unless they are of "particular" significance to the Philippines. Critics call it an affront to the sovereign integrity and independence of the Philippines. Calls for its review and scrapping intensified following the 2005 arrest of Marine Lance Corporal Daniel Smith for the rape of a Filipina tagged as "Nicole" in Subic, site of a former US military base.

Wikipedia writes that: “Throughout the trial, the issue of U.S. vs. Philippine custody on the accused U.S. Marines was the focus of street demonstrations and protests by political groups and women's rights advocates, and it was a hot news item in the Philippine press.” The Makati Regional Trial court sentenced him with reclusion perpetua on December 4, 2006, making Smith the first American serviceman convicted of rape under Philippine jurisdiction. The Subic rape case would continue to be the rallying crux of nationalist and anti-American protest actions against the VFA.

VFA Jurisdiction Issue of US Soldiers Involved in Crimes

For much of the trial and post-conviction, Smith was under the custody of the US Embassy, following the agreement made between the Philippine Foreign Affairs Secretary and the US Ambassador to the Philippines in December 2007. The US earlier canceled the yearly Balikatan joint military exercises during the time Smith was in Philippine custody.

A lower court ruled to assert the power of the Philippine over US troops in the country, but amidst the disagreement with the judicial and executive branches, left the issue of custody with the government to decide. The camp of “Nicole” later filed an indirect motion of contempt against the transfer of Smith to the US embassy, and also questioned the constitutionality of the VFA. The Supreme Court declared the VFA constitutional and ruled the Philippine government should forthwith negotiate with US representatives on the appropriate detention facilities under Philippine authorities, in accordance with the VFA.

The Supreme Court ruling, however, failed to appease the nationalist sentiments against, and the leftist protests over, Smith's continued detention at the US embassy. The controversy has served to catalyze serious calls for the abrogation of the RP-US Visiting Forces Agreement.

Obama's Call and US Covert Hand

As much as Obama's call came as a "surprise" to Malacanang, the Filipino public was surprised mega-time with the subsequent news that Smith's rape victim, "Nicole," has terminated the services of her lawyer and has gone to live in the US-of all countries. The development came within only three days of Obama's call, no matter that Malacanang earlier denied that the case of LCpl. Smith was not discussed with Arroyo.

The mother of "Nicole," gives notice terminating services of Subic rape case attorney;
Informs counsel that Nicole is already in the US "for good"; Nicole's media statement vaguely complains of the state of justice in the Philippines

Speculations are now rife that the US government, with help from the Philippine government, has pressured "Nicole" into migrating "for good" in order to take the heat off from VFA. Officially, Smith's rape victim received P100,000 in moral and exemplary damages. Filipino Senator Jamby Madrigal says that the offer must have been irresistible. The US Embassy will not comment, but it seems the US visa is part of the deal because according to Justice Secretary Raul Gonzales what she had filed for earlier was for an Italian visa.

The press statement released by "Nicole" and expressing disappointment over the Philippine justice system, thus, becomes disconcerting because common sense tells that if it is justice she really seeks, she should not have chosen to reside in the country of her attacker. It simply does not make sense how she could trust the very government that has refused to turn over her rapist, LCpl. Smith, to the jurisdiction of the Philippine justice system. The fact is that Nicole has already won the case in terms of proving that she has been raped--with the comforting help of thousands of, although definitely not all, Filipinos who believed in her story and wished for her court victory. She not only got Smith convicted, but, as well, won the custody issue, even if only for a brief period.

Day 4 - Tuesday, March 18, 2009 (HK GMT)

- "Nicole" "recants" thru an affidavit
- First post-conviction recantation in Philippine history - Virtually absolves Smith of rape; assumes her share of responsibility for the sexual act

If Day 3 brought surprise with the news of the rape victim's migration, Day 4's retraction news stunned the Filipino public. After four years of fighting for justice in her case, going against the US military, winning a conviction of life against Smith, and winning a lower court order denying Smith's request to be put under the custody of the US Embassy, "Nicole" recants and suggests that what she had with Smith could have been consensual sex. After Judge Pozon believed her story, disbelieved and convicted Smith, based on forensic findings of contusions, presence of sperm DNA, and blood on her private parts, on witnesses who saw her crying after being dumped somewhere in Subic, she now says she is bothered by her conscience as Daniel Smith could have really been innocent of rape? All these within only three days of the Obama call.

Sorry, but the running script sounds unbelievable, especially since this author saw the media news interview of the van driver who witnessed the rape of Nicole soon after it happened in 2005. The account, which seemed spontaneously given and done under no duress, pretty much substantiates the forensic evidence in the Subic rape case.

Amidst the dynamics of Philippine historical subservience to its former colonizer, the timings of the Chinese interception of USNV Impeccable, of Obama's call, and the sudden, surprising migration of "Nicole," along with the implausible media statements and recantations she supposedly signed, it's hard not to connect the VFA and Uncle Sam to the development and not suspect that a settlement has been arranged.

A number of Philippine lawmakers believe the recantation/migration was a US handiwork, with a party-list solon saying that Nicole is the scapegoat in the scheme to save the RP-US Visiting Forces Agreement from possible abrogation due to the sovereignty issues her rape case have given rise to. 2004 vice-presidential candidate Sen. Loren Legarda expressed concern that "While America keeps its processes intact and its soldiers protected, [Filipino] morality as a nation is trampled upon... justice system spat on,”

While this author understands the practical compromises necessitated by the realities of geopolitics, what is sickening about this Nicole-VFA-Smith settlement is that it puts Filipinas, as well as accusations of rape, in a bad light, both within the Philippines and outside. Marine LCpl. Daniel Smith is a convicted rapist, judiciously tried by a court of law. Pressuring, or enticing, his victim into absolving him and incriminating herself in the process present pretty serious judicial and societal ramifications .

For one, given the persisting machismo thinking among Filipinos, the high-profile case could also lead people not to consider rape cases more seriously. The development may also reinforce the belief that the rape of drunken women is justified.

Lawyer Katrina Legarda, who has handled prominent rape and other women's issue cases, believes it is a setback because judges may now think twice before handing "guilty" verdicts. The retraction, if true, could add to the negative perceptions of Filipinas: perhaps as objects of rape who can be later bought, or as liars who use sex in extortion.

'Hope, Change' in Foreign Policies Or False Hope?

If the US of A is agog to keep the Subic rape case out of the way of the Visiting Forces Agreement, can't just they ask the stalking Arroyo to pardon Smith of the crime of rape? Perhaps, Smith should be told to muster all sincerity there is in him and then publicly apologize with Nicole for the crime of rape. That should appease many Filipinos enough, particularly since he's generally taken as a handsome, gentle-looking guy. Of course, under such a scenario,the US visa offer to Nicole should stay, whether she takes it or not under 'normal' Malacanang and US pressures.

Then again, who knows what exactly Obama discussed with Arroyo, aside from his staff at the White House and the Defense Department, of course? If the "Hope, Change" electoral mantra is to be (gullibly?) used as the metric of assessing and predicting the 44th US President's foreign relations track, he could very well have faulted Arroyo for her corruption record and her power grab twice over. Perhaps, there was really no mention of the rape case of Smith whatsoever. Another and not-so-bad a scenario would be Obama actually having discussed the Subic rape case, but having promised to make the RP-US Visiting Forces Agreement less one-sided by including rape in the crimes to fall under Philippine jurisdiction.

Hope it's not wishful thinking. Or isn't it? Calling on your campaign promise of "Change," Your Excellency Brother Barack Obama.

The Stupidity of the EDSA 2 "People Power" Gullibles Relived

A running broadcast advertisement is reliving the stupidity of the EDSA 2 crowd conned into deposing the constitutionally-elected Joseph Estrada and installing Gloria Arroyo as successor. The anniversary advert running in Philippine television stations shows Arroyo swearing in as "acting President" amidst the seditious sea of mob humanity who flocked the streets of EDSA. What follows is a series of 'testimonies' of ordinary individuals who claim to have experienced economic gains after the revolutionary change in government. Amidst the consistent surveys showing the worst levels of hunger, worst perceptions of corruption and worsening personal and national quality of life and--all under Arroyo’s illicit reign--the political spot comes as almost a complete joke.


This laughable political advert is part of the "Arroyo administration's seventh anniversary celebration of the now infamous EDSA 2 putsch-cum-People Power that overthrew the popular Estrada, and which sent the Filipinos into seven years of polarization and political instability. It illustrates how Arroyo has used the power of media to seize power and even, to maintain her hold on it.

The traditional local media had largely hailed the 2001 coup as a "People Power" triumph over the supposed corruption of President Estrada. In fact, the mainstream broadcast and print Philippine media have served as an influential force in advancing the demonization and ouster of the sitting President and further, in deviously disguising before the Filipinos the constitutional anomaly that is EDSA 2.

Anti-Estrada Propaganda

The 'Estrada is Guilty' and 'long live EDSA 2!' propaganda campaigns participated in by most of the Philippine media actually began months prior to January 2001 during the drive to depose President Estrada. In what has been later exposed to be a well-orchestrated scheme by elitist elements that included the camp of then Vice-President Arroyo and former President Fidel Ramos, the local broadcast and print media played an instrumental role in demonizing Estrada and generating some public support for his ouster. Soon after Estrada decided to leave Malacanang to avoid any possible confrontation with his followers, the largest television stations, GMA-7 and ABS-CBN, ran for several weeks their 'victory' footages of the four-day revolution, acclaiming it as supposedly a victory for democracy in the land.


In contrast, the foreign media were in general agreement in their critical coverage of EDSA 2, describing the event as a power grab instead of as transition enabled by "People Power." Phil Bowring of the International Herald Tribune decried the impeachment walkout and the revolt, saying that "far from being a victory for democracy that is being claimed by leaders of the Anti-Estrada Movement such as Jaime Sin, the evolution of events has been a defeat for due process.” Time Magazine, in its February 19, 2001 issue, saw how “People power 2 was swift justice indeed--as in a lynching, it repudiated the very essence of due process enshrined in the constitution.”

Even foreign politicians and analysts shared the criticism of EDSA 2. Then Singapore Senior Minister Lee Kuan Yew was quoted by The Straits Times on how he viewed "the change of power in the Philippines [as being] no boost for democracy because it was done outside the constitution." Wikipedia also quotes Hong Kong-based political analyst William Overholt who referred to EDSA 2 as "mob rule or mob rule as a cover for a well-planned coup."

In contrast to what the local media wanted the Filipinos to believe, EDSA 2 was no real showcase of "People Power" but rather, the fruition of a sophisticated and complex power grab conspiracy. Part of the planning and execution of the coup-in-disguise included the exercise of subtle psychological warfare by a major general who is a veteran in this game. In the midst of the Estrada impeachment, his predecessor Fidel Ramos--himself beleaguered by corruption charges--marched on the streets of EDSA in a move that seemed to (successfully) beckon the people to protest and follow suit.

People Power II Myths

Contrary to the lying claim propagated by the Arroyo administration and EDSA 2 stalwarts though media propaganda, the unseating of Estrada did not come about because of a well-intentioned, spontaneous popular revolt. An interview conducted by renowned author Nick Joaquin and which first appeared in the Philippine Graphic revealed that a power grab from Estrada had been planned long before the impeachment and that two of the key putschists were no other than Gloria Arroyo and her husband Mike Arroyo. With or without a popular component, the overthrow of the President with the highest plurality vote in history would have pushed through.

The defection of the military's top brass was the focus of the putschists' Plan A. This priority plan was what brought in the campaign to bring people to EDSA through media propaganda and centralized invitation by cellular texting. Arroyo's camp managed to convince then Chief-of-Staff Angelo Reyes to join, but on the condition that there will be a million-strong crowd in the streets of EDSA to help convince the service commanders to join.

Arroyo and Singson's camp also had a Plan B that included having elements of the military strike the initial blow by withdrawing from the government, to be followed by other groups such as the Philippine Military Academy graduates from Class '71, Class '72, etc. Moreover, they had a bloody "back-up strike force" given the orders to shoot against every place in Metro Manila and the provinces where Estrada forces will resist. It is herein seen that the unseen hand that directed the propaganda and political machinations against Estrada had a heartless determination to grab power. For all the illusions of the EDSA 2 people, it has become apparent that they had simply served as pawn to overthrow a very popularly elected leader. Worse, the EDSA "People Power" principle of a peaceful revolutionary change in government was in no way a consideration for the elitist elements who never respected the millions of masa (lower-class) votes received by Estrada.

Concededly, though, idealistic elements were present in the civilian support of EDSA 2. No less than members of the youth and the academic community lend some dignity to the rebellious occasion. It is even safe to state that the country's premiere university, the University of the Philippines, attended in majority force. It is just so sad that for all their intelligence and patriotic aspirations, the more honorable of the EDSA 2 civilians had been, well, had. Conned by political opportunists and elitist elements who envision democracy to work according to their convenience, they prejudged Estrada as guilty without the benefit of a fair and complete trial. The seemingly possessed EDSA 2 mob then dropped half their principles and acted in a Machiavellian fashion to taunt, jeer and malign Estrada. The climax came rather swiftly as the threat of the lynching mob--foolhardily ignorant of the putschists' machinations--was conveniently used to negotiate Estrada's departure from Malacanang. Aided by the seditious "party" animal, then Supreme Court Justice Hilario Davide, and failing to smell the odor of the wicked wolf in their midst, the pathetically jubilant mob then foolishly handed the Presidency to Gloria Macapagal Arroyo in a silver but tainted platter.

Revolution towards Greater Hunger and Corruption

It is most ironic that the 'Oust Estrada' campaign rode on the wings of anti-corruption and moral recovery promises but ended up driving the country into probably unprecedented post-war levels of misery, a corruption and immorality.



2007 was particularly a year of ignominy for Arroyo on several counts. Despite her proud but dubious claims of steering the country into economic stability, a Social Weather Station survey study shows that the level of total hunger hit its highest last year--the second time in her administration. Another 2007 survey, this time by Pulse Asia, betrays how Filipinos consider themselves and their countrymen worse off now than some years back ago.

It is in the area of morality, however, that Gloria Arroyo received the worst disgrace of her political life. The October 2007 Pulse Asia nationwide survey on corruption revealed how Filipinos view her as the "Most Corrupt President in Philippine History." The survey results prove particularly embarrassing not only for Arroyo but, perhaps, also for those responsible for her unconstitutional ascent into the Presidency because she even beat Guinness-holder Ferdinand Marcos for the inglorious title. Estrada, who has faced the politically-suspect Plunder charges and seven years of consistent demonizing by the Arroyo administration and elitist camps, placed only third in the list. What had made Gloria Arroyo top the "Most Corrupt" list is nothing else but a long litany of corruption issues that began soon after the EDSA 2 "People Power" gave her the reigns of illicit power.

Mea culpa

A number of personalities and participants of EDSA 2 have already admitted to the mistake, nay stupidity(?), of the Estrada ouster. Prominent among them is former President Corazon Aquino. While admission and penance may not necessarily bring back the constitutional order of the government, nor undo the defamation of Estrada, nor perhaps the lives of those who died by hunger or poverty-related suicide due to corruption of public funds, nor return the lost honor of the Supreme Court, it is a step in right direction. The zeal for change may sometimes override sobriety and foresight, and lead people to stupid decisions. Let EDSA 2, then, be a bitter blunder to rectify because otherwise, the nation as a whole will suffer worse.
